The Latest News in Marijuana Legalization in Maine

After years of delays, recreational sales of marijuana in Maine will begin on October 9, 2020. These sales begin almost four years after marijuana legalization was approved by voters through a ballot measure, a much longer timeframe compared to many other states that have legalized marijuana. 

Maine’s cannabis regulatory body began to issue marijuana business licenses on September 8, 2020. Marijuana businesses can start harvesting, processing, and conducting quality control for their products once they are issued a license. 

As of September 14, Maine has licensed five recreational grow sites, five retail stores, one manufacturing facility, and one testing lab.

The city council of Maine’s largest city, Portland, voted to cap retail store licenses at 20. In determining which applicants will be awarded licenses, the city council will prioritize the following factors: 

  • Medical marijuana caregivers
  • Majority owned by an economically disadvantaged applicant 
  • Prior experience with managing regulated/licensed commercial operations
  • Plans to pay employees a fair wage and good benefits
  • Already has ownership or longstanding lease of business location 
  • Well capitalized, with $150,000 or more in liquid assets

Maine marijuana legalization law permits local municipalities to opt-in or opt-out of legalization. So far, less than 10% of the state’s nearly 500 municipalities have opted in. However, the municipalities that have opted-in include the states most populous metropolitan areas: Portland, Lewiston, Bangor, South Portland, and Auburn.

History of Marijuana in Maine

Possession of small amounts of marijuana was decriminalized in Maine in 1976, and the first medical marijuana legalization measure was passed in 1999. This measure permitted certain medical patients to grow their own marijuana plants. On the local level, the cities of Portland and South Portland decriminalized possession and recreational marijuana use in 2013 and 2014, respectively.

In 2016, a ballot initiative to legalize the use and sale of marijuana statewide passed narrowly by less than one percentage point. The ballot initiative stated that commercial marijuana sales would be taxed at 10%, and local authorities would have the power to regulate, limit, or prohibit the operation of commercial marijuana sale. 

Retail sales were set to begin in February 2018 — a little over two years after the ballot initiative passed to give agencies time to determine how to regulate the new marijuana industry. However, in November 2017, Maine Governor LePage vetoed a marijuana taxation and regulation bill, arguing that it conflicted with federal law. The state legislature overturned the veto on May 2, 2018. The bill became law, but the commercial sale timeframe was delayed.

Commercial sales of marijuana were set to begin in the spring of 2020, but the COVID-19 pandemic delayed the timeline until the early fall of 2020.
