Portugal’s relatively lenient policy on marijuana stems from the country’s effort to reform drug policy in the late 90s. For several decades prior, Portugal had dealt with high rates of drug use and high rates of incarceration. In 2001, officials made the bold decision to decriminalize the personal use of all drugs and focus on rehabilitation instead of punishment. If an individual is caught in possession of cannabis in Portugal, they are sent to a local Commission for Dissuasion of Drug Addiction, which consists of a legal expert and two medical professionals/psychologists. This commission reviews the case and decides if treatment is necessary to combat addiction.
Cannabis social clubs exist in Portugal, although they are technically illegal as cultivation is illegal. Marijuana advocates and some politicians have advocated for making these clubs officially legal, as similar clubs have worked well in neighboring Spain. In 2013, the political party Bloco de Esquerda entered a proposal to parliament to legally allow these clubs to cultivate marijuana, but the proposal wasn’t accepted.
