Regulatory Status of Cannabis in Missouri

As of June 13th, Missouri gave the go-ahead to a St. Louis-based cultivation facility to begin operations, the first facility so licensed. For everyone else still in the application process, they must follow specific steps to be approved.
Anyone applying for a license should be advised that the Department of Health & Senior Services (DHSS) is only accepting applications for seed-to-sale and transportation at this time. Licenses for cultivation, testing, manufacturing, and dispensaries are unavailable.
If you complete and submit an application to the department, you will receive an approval or denial within 150 days.

Competition for a medical marijuana license of any kind in Missouri is stiff. Before the deadline, the DHSS received 2,163 applications for medical marijuana facility licenses.

Requirements for a Cannabis License in Missouri
While a license or certification does not authorize a facility to begin operations, it’s a big step towards opening your business. Minimum requirements for obtaining a permit (varying by the facility type) are as follows:
- You must be authorized to operate a business in the state of Missouri.
- The entity must be majority-owned by Missouri residents of at least one year.
- The entity must not be under substantially common control as another entity.
- The business must not be located with 1000 feet of a school, daycare facility, or church.
- You must be eligible to operate in your local jurisdiction.
- The company cannot be owned, partially or in whole, or have any contributing member with a disqualifying felony offense.
In addition, anyone involved with the facility at any level must submit fingerprints for a criminal background check. Instructions for fingerprint submittal, as well as all steps regarding the pre-license state, after-license measures, and license denial appeals, are available on the DHSS website.
