In June 2020, Louisiana cannabis regulations shifted to make it easier for medical marijuana patients to obtain cannabis. The Louisiana legislature met and passed three bills:

•HB 819: Physicians can now prescribe medical marijuana for any patient under their area of expertise if they think the condition is debilitating. Some of these conditions include

  • Traumatic brain injury
  • Parkinson’s
  • Alzheimer’s
  • ALS
  • Chronic pain caused by fibromyalgia or sickle cell anemia
  • Concussions
  • Palliative care or hospice care patients

• HB 211: This bill protects banks that have medical cannabis businesses as customers from receiving penalties.

• HB 418: This bill extends protections to physicians and other medical facilities that use medical cannabis.

State laws regarding recreational use have yet to be changed or amended, but advocates hope to see progress happen in that area.

Important Compliance Considerations for Louisiana Cannabis Regulations on METRC

As part of the most regulated industry in history, cannabis operators face intense scrutiny from local and state governments. METRC, a seed-to-sale tracking system, helps operators stay compliant by creating an easily identifiable chain of custody for each cannabis product. Mandated in 15 states plus Washington D.C., METRC is similar everywhere. However, there are nuances in each state. In order to remain compliant, businesses must be aware of and adhere to their state’s specific regulations.

In the great state of Louisiana, the Department of Agriculture and Forestry as well as the Board of Pharmacy oversee cannabis-related regulations. Unfortunately, neither of these agencies can come up with an efficient method of training. 

For now, one person from each cannabis operation is trained and the responsibility then falls to them to train others. This style of training is immensely error-prone, so additional training and METRC support may be necessary.

The History of
Cannabis in Louisiana

A majority of Louisiana’s citizens are in support of legalizing marijuana, but the state itself has some of the toughest cannabis laws in the country. One can potentially be jailed for up to six months if they are found in possession of a single joint for recreational use. That being said, Louisiana was also one of the first states to legalize medicinal marijuana in 1978, but it was only for those suffering from glaucoma or patients receiving chemotherapy treatment for cancer. The language of the law made it very difficult for them to obtain it, so a new law was implemented in 1991 that also included those with spastic quadriplegia to be able to use medical marijuana.

That second law also had confusing language, so Louisiana lawmakers again spent years working to create a new framework that was finally launched in 2015. By 2019, the state was starting to dispense medical marijuana to patients who met the new guidelines for obtaining it, and that bill included many other medical conditions. Further improvements were made in 2020.

In 2016, the city council of New Orleans voted to decriminalize marijuana within the city itself, and since then, arrests have decreased significantly. Statewide, however, there are still many arrests.

As of now, the state of Louisiana only has two approved growers for marijuana – Louisiana State University and Southern University. Only LSU has harvested the crop.

The state has only nine licensed dispensaries. As far as legal ways to use the plant, the state does not allow the sale of whole flowers and does not permit smoking marijuana, either. In 2019, they did pass a bill allowing for marijuana to be inhaled with a metered-dose inhaler. This is a restrictive policy and makes it more difficult for low-income patients to gain access to medical marijuana.
