Beyond the Colorado MED badge: The Latest Opportunities in Colorado Cannabis

Since January 1st, 2020, Colorado has seen several changes and associated opportunities within the cannabis industry:

  • Hospitality establishments are now open for cannabis licensing opportunities. This includes, but may not be limited to:
    • Bus tours
    • Cannabis use lounges
    • Cannabis cafés
    • Designated areas in hotels
  • Existing food establishments may apply for a cannabis hospitality establishment license with the following considerations:
    • Subject to local approval
    • For (or within) a specified portion of the restaurant
    • The food establishment seeking license may not possess a liquor license
    • This provision does not allow the restaurant to add cannabis products to their food
  • All products consumed at a cannabis hospitality establishment must be purchased from a medical or adult use dispensary

Further information regarding the new license type’s application can be found in the Marijuana Enforcement Division area on Colorado’s Department of Revenue website. Remember, the Marijuana Enforcement Division requires a Colorado MED badge for any type of cannabis business.

Other cannabis changes include:

  • Effective January 1, 2020: all vape additives including vitamin E acetate, polyethylene glycol (PEG) and Medium Chain Triglycerides (MCT oil) are banned.

Effective July 1, 2020: it will be legal to sell industrialized hemp products within dispensaries. ** Hemp products will still have to undergo the same required testing as all other cannabis products that enter dispensaries in Colorado.

Important Compliance Considerations
for Applying For a Colorado MED Badge

As part of the most regulated industry in history, cannabis operators face intense scrutiny from local and state governments. METRC, a seed-to-sale tracking system, helps operators stay compliant by creating an easily identifiable chain of custody for each cannabis product. Using METRC makes recalls easy and ensures accountability. Obtaining a Colorado MED badge is the first step to ensuring METRC compliance.

Mandated in 15 states plus Washington D.C., METRC is similar everywhere. However, there are nuances in each state. In order to remain compliant, businesses must be aware of and adhere to their state's specific regulations.

Unlike California, Colorado works closely with the METRC team. As a result, quite a few helpful updates to the system have come out of state.

Through the state's Marijuana Enforcement Division (MED), Colorado aims to improve METRC so that it serves the state and the community equally. A Colorado MED badge is required to legally work at or develop any business where THC is grown, processed, extracted, or sold. To further this goal, Colorado offers online METRC training that's simple and straightforward.

Colorado first legalized cannabis for medical use in 2000 and was one of the first two states to legalize cannabis for adult use in 2012. Cannabis competition in Colorado is tough, but so are regulatory and compliance efforts. With 20 years of cannabis experience, Colorado understands the importance of adhering to stringent compliance standards and enforces them through the Marijuana Enforcement Division (MED).

The MED oversees all cannabis licensing and operations. These licenses include cultivation, manufacturing, dispensary, operator, transporter, testing facility, and hospitality and sales businesses. This means that a Colorado MED badge is required for anyone working in the cannabis industry in Colorado. Colorado also mandates the use of Marijuana Enforcement Tracking Reporting Compliance (Metrc), a system that monitors statewide seed-to-sale to track the cannabis, in all forms, from its inception to its purchase.

While Colorado provides state laws and oversight, each municipality also has their own set of rules and regulations, and this may differ among municipalities. For example, some cities prohibit the sale of cannabis and some cities cap the number of Colorado MED badges awarded. Due to these inconsistencies, it is imperative to conduct research prior to applying for a license in such a competitive state with an array of different licensing options and laws that vary from city to city.
